1) What these Terms cover
These Terms govern your access to and use of PhotoWeather's websites, apps, and related services (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2) Who may use the Service
- You must be at least 18 (or the age of majority in your country).
- If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
- EU/EEA consumers retain all mandatory rights under applicable law; nothing here limits those rights.
3) Your account
- Keep your credentials confidential. You're responsible for activity under your account.
- Tell us promptly about any unauthorized use or suspected breach.
- We may suspend or terminate your account if necessary to protect the Service or others, including for security, fraud, or policy violations.
4) The Service (availability & changes)
- We continually improve the Service and may add, change, or remove features.
- We'll make reasonable efforts to notify you of material changes that negatively affect core functionality.
- The Service is informational only and not for safety-critical use (e.g., aviation, marine, emergency decision-making).
5) Subscriptions, billing, and taxes
- Some features require a paid subscription ("Plan"). Plans auto-renew until you cancel.
- You authorize us (and our payment processor, e.g., Stripe) to charge your payment method for each renewal term.
- Prices may change; we'll give prior notice where required. If you don't agree, cancel before the next renewal.
- Displayed prices may exclude taxes; where applicable, taxes will be added.
6) Trials and promotions
- If you're on a free trial or promotional offer, once it ends, regular billing starts unless you cancel before the trial ends.
- We may modify or withdraw trials/promos at our discretion.
7) Your right to cancel (and EU/EEA withdrawal)
Cancel anytime: You can cancel in the app or by contacting us. Your Plan stays active until the end of the current billing period; then it won't renew.
EU/EEA consumer 14-day withdrawal:
If you buy a paid Plan as a consumer, you can withdraw within 14 days of purchase without giving a reason. If you ask us to start providing the Service immediately (e.g., by accessing paid features during the 14-day period), you may owe a proportionate amount for the period used before withdrawal. We'll explain this at checkout where required and provide a model withdrawal form upon request. To exercise the right, email privacy@photoweather.app .
Refunds: Outside the 14-day EU/EEA withdrawal right (or where not applicable), fees are generally non-refundable except where required by law or our posted refund policy.
8) Acceptable use
You agree not to:
- Break the law, infringe others' rights, or violate these Terms.
- Attempt to access the Service or related systems without authorization, or interfere with their operation.
- Scrape, harvest, or reverse-engineer the Service except where permitted by applicable law and then only to the extent of that permission.
- Abuse rate limits, spam notifications, or use the Service for high-risk or safety-critical decisions.
9) Your content & our license
- You retain ownership of content you submit to or store in the Service (e.g., locations, rules, settings).
- You grant us a worldwide, non-exclusive, royalty-free license to host, process, transmit, and display that content only as needed to operate, secure, and improve the Service.
- We may generate aggregated or de-identified statistics (e.g., usage metrics) that do not identify you; we may use these for analytics and Service improvement.
10) Third-party services
The Service integrates with third-party providers (e.g., weather data from Open-Meteo; payments via Stripe; email via Amazon SES; hosting on Hetzner Cloud and AWS). Your use of those providers may be subject to their terms. We're not responsible for third-party services we don't control.
11) Beta features
We may offer features marked as alpha, beta, preview, or test. They may be less reliable or change more frequently. You use beta features at your own risk within the limits of applicable law.
12) Intellectual property
The Service, including software, design, graphics, and trademarks, is protected by IP laws. Except for your rights to use the Service under these Terms, we reserve all rights.
13) Warranty disclaimer
Except as required by law, the Service is provided "as is" and "as available." Weather forecasts and related outputs can be inaccurate or unavailable. We do not make guarantees about accuracy, availability, or fitness for a particular purpose. This disclaimer does not limit statutory consumer warranties you cannot waive.
14) Limitation of liability
To the maximum extent permitted by law:
- We're not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenues, data, or goodwill, arising from or related to your use of the Service.
- Our total liability for any claim is limited to the amounts you paid to us for the Service in the 12 months before the event giving rise to liability.
These limits do not exclude liability that cannot be limited under applicable law (e.g., for gross negligence or willful misconduct), and they do not reduce your mandatory consumer rights.
15) Termination
You may stop using the Service at any time and can delete your account in the app or by contacting us. We may suspend or terminate your access if you materially breach these Terms, create risks for others, or if we're required to do so by law.
16) Privacy
Your use of the Service is also governed by our Privacy Policy . It explains what we collect and why, including our use of strictly-necessary cookies/local storage for authentication and preferences.
17) Changes to these Terms
We may update these Terms from time to time. If a change is material, we'll provide reasonable notice (e.g., in-app notice or email). The updated Terms will apply from their effective date. If you continue using the Service after the effective date, you accept the updated Terms.
18) Governing law & disputes
These Terms are governed by the laws of Finland,
without regard to conflict-of-law rules. If you are an EU/EEA consumer, you also enjoy any
mandatory protections of your country of residence.
Disputes may be brought before the competent courts of Finland, or—if required by consumer
law—in the courts of your habitual residence. Consumers may also use local alternative
dispute resolution bodies where available.
19) Force majeure
We are not responsible for delays or failures caused by events beyond our reasonable control (e.g., internet outages, DDoS, natural disasters, war, government actions).
20) Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, corporate reorganization, or sale of assets.
21) Severability & entire agreement
If any provision is unenforceable, the rest remain in effect. These Terms, together with any plan-specific terms and the Privacy Policy, are the entire agreement between you and us regarding the Service.
